1. Introduction
Tus Ojos Inc. ("Tus Ojos," "Tus Ojos Eyecare," "we," "us," or "our") respects the privacy of our patients, customers, prospective patients, website visitors, and members of the communities we serve.
This Privacy Policy describes how Tus Ojos Inc. collects, uses, discloses, protects, and retains personal information when you visit tusojoseyecare.com, communicate with us, submit an appointment request, contact one of our offices, receive electronic communications from us, or otherwise interact with digital services that link to this Privacy Policy.
Tus Ojos Inc. currently operates locations in Camden, New Jersey; Philadelphia, Pennsylvania; and Cherry Hill, New Jersey.
This Privacy Policy applies to information collected through our public-facing website and related digital interactions. Different notices, authorizations, agreements, or legal requirements may apply to information collected in person or through particular clinical, insurance, payment, or third-party systems.
2. Information We Collect
Information you provide directly may include: first and last name; email address; telephone or mobile number; mailing address; preferred Tus Ojos location; preferred language; whether you identify yourself as a new or existing patient; appointment-request information; preferred appointment date or time; general reason for requesting an appointment; communication preferences; messages you send through a contact form; information you voluntarily provide when communicating with our staff; eyewear or product inquiries; and other information reasonably necessary to respond to your request.
We encourage users not to submit Social Security numbers, complete payment-card information, detailed medical records, account passwords, government identification numbers, or other unnecessary sensitive information through general website contact forms.
Information collected automatically may include: IP address; browser type; device type; operating system; referring website; pages visited; date and time of access; approximate geographic region derived from technical information; language preferences; interaction with website features; cookie and consent preferences; and diagnostic or security information.
The actual technologies used on the website may change over time. Our Cookie Preferences tool should reflect the technologies currently deployed.
3. Appointment Requests
Information submitted through an appointment-request form may be used to route the request to the selected location; enable our staff to contact you; assist with scheduling; identify whether you indicated that you are a new or existing patient; understand the general type of service requested; and maintain an internal record of the request and follow-up activity.
Submitting an appointment request through the website does not create or confirm an appointment. An appointment is confirmed only after Tus Ojos Inc. or an authorized representative provides confirmation.
Please do not use an appointment-request form to communicate an emergency.
4. Existing Patients
If you identify yourself as an existing patient, we may use the telephone number or other information you provide to assist authorized staff in locating the appropriate internal record.
For privacy and security reasons, the public website does not disclose whether a particular person, telephone number, or email address is associated with an existing Tus Ojos record.
If a record cannot be matched automatically, the request may still be forwarded to staff for follow-up.
5. How We Use Personal Information
To provide and operate our website; process appointment requests; respond to inquiries; communicate with you; provide requested services or information; route communications to the appropriate office; maintain customer and appointment-request records; provide appointment-related communications; support customer service; manage eyewear, contact-lens, or product inquiries; personalize basic website preferences; administer promotions; maintain website security; detect and prevent spam, fraud, abuse, and unauthorized activity; troubleshoot technical problems; improve website functionality and user experience; measure non-sensitive website performance; administer our business; maintain legally or operationally necessary records; enforce our policies and agreements; protect our rights and the rights or safety of others; and comply with applicable legal obligations.
We will not intentionally use sensitive information submitted through appointment or contact forms to create advertising audiences based on a person's specific medical concern.
6. Communications Providers
Tus Ojos Inc. uses Weave for certain telephone, text-messaging, office-communication, scheduling, and related functions. Information necessary to communicate with you may therefore be processed through Weave or other authorized communications providers.
Depending on the service requested, information shared with communications and technology providers may include your name; phone number; location; communication preference; appointment-request status; and information reasonably necessary to facilitate the requested communication.
We select third-party providers for legitimate business purposes, but third parties may also maintain their own terms, privacy policies, and security practices.
7. Email Communications
Tus Ojos Inc. may send service or relationship communications, such as responses to inquiries, appointment-related messages, transaction information, or other communications requested by you; and marketing communications, such as information about eyewear, promotions, events, or services.
Marketing emails will provide an appropriate method for unsubscribing. Unsubscribing from marketing does not necessarily prevent service-related, administrative, security, transaction, or appointment communications.
8. SMS and Text Messaging
If you request or consent to text-message communications, we may communicate with you at the mobile number you provide. Text-message activity is also governed by our SMS Terms & Conditions.
Marketing text consent, when requested, is separate from ordinary appointment or customer-service choices and is not required as a condition of purchasing products or requesting services.
9. Cookies and Similar Technologies
Tus Ojos Inc. may use cookies, local storage, tags, analytics technologies, pixels, and similar technologies, organized into four categories:
- Strictly Necessary — security; session management; website operation; form functionality; spam prevention; consent management; language preference; and essential accessibility preferences.
- Functional — optional website preferences or convenience features.
- Analytics — website performance and general patterns of use.
- Advertising and Marketing — when enabled, campaign measurement, advertising, or similar marketing functions.
Visitors are provided with an accessible Cookie Preferences mechanism allowing them to control optional categories.
10. Analytics and Advertising
Tus Ojos Inc. may use authorized analytics or advertising platforms. These technologies are configured so that Tus Ojos does not intentionally transmit information entered into appointment or contact forms, including names; submitted email addresses; submitted telephone numbers; appointment-request details; free-text messages; prescriptions; medical concerns; or other sensitive information.
Appointment form values must not be included in advertising URLs, analytics event names, marketing audiences, or advertising-platform parameters.
11. Promotions
The website may display location-specific, language-specific, or general promotional messages. Tus Ojos may collect non-sensitive information about promotion performance, such as promotion displayed; promotion clicked; language; general location page; campaign identifier; and whether a scheduling CTA was initiated.
We do not use information entered into a subsequent appointment form as advertising analytics data.
12. How We Disclose Personal Information
Service providers — companies that provide technology, communications, website hosting, cybersecurity, form processing, email, text messaging, payment, analytics, or other services on our behalf.
Professional advisors — attorneys, accountants, auditors, consultants, insurers, cybersecurity providers, and other professional advisers where reasonably necessary.
Government and legal authorities — where disclosure is required or permitted by applicable law, legal process, regulation, court order, or legitimate governmental request.
Business transactions — in connection with an actual or proposed merger, acquisition, financing, reorganization, sale, transfer, or similar business transaction, subject to applicable requirements.
Protection of rights — where reasonably necessary to detect fraud, address security incidents, enforce agreements, or protect Tus Ojos, users, or others.
Tus Ojos Inc. does not sell SMS opt-in consent or SMS opt-in information to unrelated third parties for their independent marketing purposes.
13. Sale, Sharing and Targeted Advertising
Tus Ojos Inc. does not intend to sell personal information for monetary consideration. Some state privacy laws, however, may define "sale," "sharing," or "targeted advertising" more broadly than an ordinary cash sale.
To the extent applicable law grants a right to opt out of qualifying targeted advertising, sale, profiling, or similar processing, Tus Ojos will provide an appropriate method for exercising that right. Our Cookie Preferences tool also provides controls for optional advertising technologies.
14. New Jersey Privacy Rights
New Jersey's comprehensive privacy law applies only when statutory applicability thresholds and other requirements are met. When that law applies to Tus Ojos Inc. and to the particular information involved, eligible New Jersey consumers may have rights concerning confirmation and access, correction, deletion, portability, and opting out of certain targeted advertising, sale of personal data, or qualifying profiling activities.
Whether a particular request falls within the law may depend on statutory definitions, exceptions, identity verification, and other circumstances. Tus Ojos may also elect to honor reasonable privacy requests even when a particular statutory right is not legally required.
15. Privacy Requests
You may contact us regarding access to personal information; correction; deletion; a copy of certain personal information; marketing preferences; advertising preferences; or another privacy concern.
Submit requests to contact@tusojoseyecare.com with the subject line Privacy Request.
We may request reasonable information to verify your identity and protect against fraudulent requests. We will respond in accordance with applicable law.
16. Universal Privacy Signals
Where applicable law requires recognition of a qualifying universal opt-out mechanism or browser/device privacy signal, Tus Ojos Inc. configures its website to honor supported signals as legally required. New Jersey law specifically contemplates qualifying technology that communicates a consumer's opt-out preference.
17. Data Retention
Tus Ojos Inc. retains personal information for periods reasonably appropriate to fulfill the purpose for which it was collected; maintain business and transaction records; manage appointment requests; resolve disputes; prevent abuse; maintain security; comply with applicable legal requirements; and establish or defend legal rights.
Retention periods vary depending on the type of information and purpose. We do not promise to retain information indefinitely.
18. Data Security
Tus Ojos Inc. uses reasonable administrative, technical, and organizational measures intended to protect personal information from unauthorized access, acquisition, destruction, loss, misuse, or alteration. These may include HTTPS encryption in transit; access controls; authentication; restricted administrator privileges; security logging; rate limiting; anti-spam measures; secure development practices; software updates; backups; and monitoring appropriate to the system.
No online service or storage system can be guaranteed to be completely secure.
19. Children and Minors
Tus Ojos provides pediatric eye-care services, and a parent or legal guardian may use the website to request services for a minor.
The general website is not designed to solicit personal information independently from young children. Children should not submit sensitive information without appropriate parent or guardian involvement.
If Tus Ojos learns that information was collected through the website in a manner that violates applicable children's privacy requirements, we will take appropriate steps.
20. Third-Party Websites
Our website may link to third-party services, including Google Maps; Facebook; Instagram; YouTube; manufacturers; payment services; and other independent websites.
Tus Ojos Inc. does not control the privacy practices of independent third parties. Your interaction with a third-party website is governed by that third party's policies.
21. Changes to This Privacy Policy
Tus Ojos Inc. may update this Privacy Policy from time to time. When changes are made, the "Last Updated" date will be revised. Material changes may also be communicated through additional notice where appropriate.
